Any co-owner may request the property (movables or immovables) to be divided among the co-owners, resp., co-ownership to be terminated.

Ideally, the co-owners agree on how to divide their jointly owned property, resp. on how to terminate the co-ownership. However, if the co-owners may not come to an agreement thereon, the matter shall be decided by the court in a non-contentious proceeding, initiated as per a petition of any of the co-owner, regardless of the size of his or her portion.

A petition for physical division is as a rule filed by one co-owner versus all the other co-owners. That does not necessarily mean that the co-owners are conflicted among each other, but they just have not come to an agreement on the mode of property division.
