Administrative procedure is a legally regulated mode of operations of all administrative bodies in resolving any administrative affair. It is composed of legal rules on mandatory conduct of the authorities in the process of resolving, in administrative affairs, the rights, obligations or legal interests of private individuals, legal persons or other parties by direct application of relevant legal regulations.

An administrative procedure may be initiated by a competent body ex officio or on the basis of the client’s request.

The competent body may initiate an administrative procedure ex officio in cases determined as such by a legislation or a legal regulation or when it is established that considering the actual factual status, an administrative procedure should be initiated with the purpose of protecting the public interest.

Administrative procedures may be general and special administrative procedures.

General administrative procedure regulates the method of work of all administrative bodies. It is regulated by the Law on Administrative Procedure.

Special administrative procedures include the rules of procedure related to special administrative areas, such as taxes, customs etc.

Administrative dispute is a special legal proceeding that follows on the administrative procedure. Namely, if a stakeholder finds a decision taken by an authority in its field of competence (or an administrative document) to be against the Law or to infringe his/her rights, that stakeholder may start an administrative dispute by filing a suit. This means that an administrative dispute implies a judicial control of the decisions taken by administrative authorities and bodies with public authority.
