Drafting Donation and Lifelong Maintenance Contracts; Real Estate Division Contracts

By means of a Donation Contract, a donor transfers an object or a property right to a donee without consideration, whereas the donee accepts the donation.

By means of a Lifelong Maintenance Contract, one party/a caregiver commits to providing care to the other party until his or her death, whereas the person receiving care commits that after his or her death, his or her entire property or a part thereof shall be transferred to the caregiver.

Lifelong Maintenance Contracts are in the domestic law regulated by the Inheritance Act of FBiH.

The best option for dividing the property among different co-owners, who all have registered ownership over a real property, but would like to physically divide it, so that each of them receives a particular portion, is to conclude a Division Contract. However, if the co-owners may not come to an agreement on the mode of terminating the co-ownership, that issue shall be decided by the court through a non-contentious proceeding to be initiated upon a request of any of the co-owners (court termination).

Condominium ownership is ownership over a specific part of the building that serves as an independent unit (such as an apartment, a garage, a commercial space). It is established as per a decision of the real property owner – Declaration of Property Division or an agreement between the co-owners – Division Contract.
