Probate proceedings in Bosnia and Herzegovina

Probate proceeding is conducted after death of an individual (testator). In the Federation of BiH, it is regulated by the Inheritance Act of FBiH.

Probate proceeding is conducted at municipal courts of the Federation of BiH, i.e. before the notary public acting as a commissioner of the competent court. It is initiated ex officio, immediately after the court finds out that an individual deceased (or was proclaimed dead) or as per a petition filed directly by a party or indirectly by the authorised lawyer.

The main purpose of the probate proceeding is to identify the testator’s heirs, establish the testator’s property and other rights belonging to his or her heirs,  legatees and others according to the law.

If the legal heirs find out after the probate proceeding that the testator had some other property that was not known to them in the course of the probate and was not covered by the decision on inheritance, they shall file a petition to the court for making a supplementary decision.

However, it often happens in practice that competent bodies simply fail to inform a successor during the probate proceeding about a right he or she is entitled to. That is when the damaged party must hire a lawyer and initiate a court proceeding for annulling the decision on inheritance.
